By booking a photography session with Pin and Pose Photography, you agree to the following Terms & Conditions. These Terms do not affect your statutory rights as a consumer.
A 50% deposit is required to secure all photography sessions.
Your appointment is not confirmed until the required deposit has been received.
The remaining balance must be paid in accordance with the payment arrangements provided for your session.
The deposit reserves studio time specifically for you. Where a booking is cancelled, any amount retained will be subject to applicable consumer law and will reflect reasonable losses arising from the cancellation.
If you need to cancel or reschedule your session, please provide at least 48 hours' notice.
Where at least 48 hours' notice is provided, your deposit can normally be transferred to another suitable appointment date.
Where less than 48 hours' notice is provided, some or all of the deposit may be retained to reflect the reserved studio time and reasonable losses caused by the late cancellation.
Any amount retained or cancellation charge will not exceed the reasonable loss suffered as a result of the cancellation.
This policy does not affect any statutory cancellation rights you may have.
If you fail to attend your appointment without providing notice, your deposit may be retained to reflect the studio time reserved and losses incurred.
A new booking and deposit will normally be required before another session can be arranged.
Pin and Pose will not charge twice for the same loss.
Where a booking is made online, by telephone or by another distance method, you may have a statutory right to cancel the contract within 14 days without giving a reason.
Where this right applies, the cancellation period normally begins when the contract is entered into.
If you ask Pin and Pose to begin providing services during the 14-day cancellation period and subsequently exercise your statutory right to cancel before the service has been completed, you may be required to pay a reasonable and proportionate amount for services already provided.
Where a service has been fully performed during the cancellation period following your express request and acknowledgement that your cancellation right will be lost once the service has been fully performed, your statutory right to cancel that service may end.
Details of how to exercise any applicable statutory cancellation right will be provided as required by law.
Nothing in these Terms affects your statutory consumer rights.
Please arrive at the agreed appointment time.
If you arrive late, your session may need to be shortened to avoid affecting subsequent appointments.
The session will normally still finish at the originally scheduled time, and the full agreed session price will remain payable.
Significant lateness may result in the session being unable to proceed.
Session durations are approximate and may vary depending on the type of photography and the needs of those taking part.
No particular photograph, pose, expression, setup or number of final images can be guaranteed.
The success of a photography session depends partly upon the cooperation, comfort and behaviour of those taking part.
Pin and Pose will make reasonable efforts to achieve the best possible results but cannot guarantee particular images where circumstances are outside the photographer's reasonable control.
Newborn photography is ideally carried out during the recommended newborn age range communicated at booking.
All posing is dependent upon the baby's age, comfort, flexibility, feeding, sleep and willingness to settle.
The baby's safety and comfort will always take priority over achieving a particular photograph.
No specific newborn pose or setup is guaranteed.
Parents and guardians must follow reasonable safety instructions during the session.
A parent, guardian or responsible adult must remain responsible for children throughout the session.
Pin and Pose cannot guarantee that a baby or child will cooperate with particular poses, setups or photographs.
Sessions may be adapted where necessary according to the child's age, mood, comfort, ability and developmental stage.
The safety and welfare of the child will always take priority over obtaining a particular photograph.
Babies develop at different rates. Milestone photography will therefore be adapted to what your baby can comfortably and safely do at the time of the session.
Sitting, crawling, standing, walking or other developmental stages cannot be guaranteed at a particular age.
Where a First Year Plan, package or other offer has additional booking, payment or attendance conditions, these will be explained when the plan is booked and will form part of the agreement.
Parents or guardians are responsible for informing Pin and Pose of any relevant allergies, intolerances or dietary requirements before the session.
Where the client provides the cake or other food, the client is responsible for ensuring it is suitable for the child.
Where Pin and Pose provides or arranges any food item, relevant allergy and dietary information must be supplied accurately in advance.
Parents or guardians remain responsible for supervising their child during the Cake Smash and any Splash Bath.
The Splash Bath is an optional extra unless specifically included in the booked session.
Owners remain responsible for their pets at all times.
Please inform Pin and Pose before the session of any known behavioural concerns, aggression, anxiety, health considerations or other issues that could affect the safety or welfare of the pet, photographer or anyone else present.
Pin and Pose cannot guarantee particular poses, expressions or behaviour from an animal.
The photographer may stop, shorten or adapt a session if continuing would create an unreasonable safety or animal-welfare risk.
Please do not attend the studio if you, your child or another participant has a contagious illness that could put the photographer or other clients at risk.
If illness prevents attendance, please contact Pin and Pose as soon as possible to discuss rescheduling.
Reasonable evidence may be requested in exceptional circumstances where repeated short-notice cancellations occur.
Clients are expected to take reasonable care while using the studio, props and equipment.
Parents and guardians remain responsible for supervising children, and pet owners remain responsible for their animals.
Where studio property, props or equipment are deliberately damaged or damaged through negligence, Pin and Pose reserves the right to seek the reasonable cost of repair or replacement.
Pin and Pose retains creative control over the photography, image selection and final editing.
The photographer will select the photographs considered suitable for the final gallery.
RAW files, unedited photographs, rejected images, test images and working files are not supplied.
The final style, composition, cropping, colour treatment and editing remain part of the photographer's professional and artistic judgement.
Images displayed on the Pin and Pose website, portfolio and social media demonstrate the photographer's style but do not guarantee identical results for every client or session.
Standard professional editing is included as appropriate to the booked session.
Requests for additional or extensive editing outside Pin and Pose's normal processing may incur an additional charge.
This may include substantial object removal, body or clothing alterations, extensive skin retouching, complex background alterations or other client-requested changes after the normal editing process has been completed.
Any additional charge will be explained and agreed before the additional work is carried out.
Finished photographs are normally delivered within 14-28 working days following the session unless otherwise advised.
Turnaround times are estimates and may occasionally be affected by circumstances outside the photographer's reasonable control.
If a significant delay occurs, Pin and Pose will inform the client as soon as reasonably possible.
Online galleries may remain available through Pin and Pose's gallery provider, but continued or indefinite availability is not guaranteed.
Clients are responsible for downloading and securely backing up their purchased digital photographs after delivery.
Pin and Pose does not guarantee that photographs, online galleries or backup files will be retained indefinitely and cannot guarantee that replacement files will be available at a later date.
Clients are therefore strongly advised to keep their own secure backups of all purchased digital photographs.
Copyright in photographs created by Pin and Pose remains with Pin and Pose Photography in accordance with UK copyright law.
Where digital photographs are supplied to the client, they are supplied for personal use unless otherwise agreed in writing.
Clients may download, print and share their purchased photographs for personal use.
Photographs must not be sold, licensed, used commercially or supplied to another business for commercial purposes without prior written permission from Pin and Pose.
RAW and unedited files are not supplied.
Clients are asked not to substantially alter, heavily filter or edit finished photographs and then present those altered versions as representative of Pin and Pose's finished work.
Booking a photography session does not automatically give Pin and Pose permission to publish or use your photographs for promotional purposes.
Permission to use selected photographs on the Pin and Pose website, social media accounts, portfolio, advertising or other promotional materials will be requested separately.
Permission may be provided in writing, including by email, text message or other written electronic message.
Where photographs feature children, permission must be provided by an appropriate parent or person with parental responsibility.
Giving permission is entirely optional. Refusing permission will not affect your photography session, the photographs you receive or the service provided to you.
Where consent is relied upon, you may withdraw that consent for future promotional use by contacting Pin and Pose.
If an image has already been legitimately published, printed, distributed or shared before consent is withdrawn, it may not always be possible to retrieve every existing copy. However, Pin and Pose will stop new promotional use where reasonably possible following withdrawal of consent.
Clients are welcome to share their purchased photographs on their personal social media accounts.
Where possible, credit to Pin and Pose Photography is appreciated.
Where a client chooses to make photographs publicly available, Pin and Pose cannot control copying, downloading, screenshotting or redistribution of those photographs by unrelated third parties.
Pin and Pose takes reasonable precautions to maintain photographic equipment and protect image files.
If a session cannot proceed or photographs are lost or become unusable because of equipment failure, serious illness or another circumstance outside reasonable control, Pin and Pose will discuss an appropriate remedy with the client.
Depending on the circumstances, this may include rescheduling or repeating the affected service, or providing an appropriate full or partial refund.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence.
Photography is subjective. Clients are encouraged to review Pin and Pose's portfolio before booking to ensure they are comfortable with the photographer's photographic and editing style.
A preference for a different photographic or editing style after the session does not by itself mean that the service has been provided incorrectly.
This does not affect your statutory rights where photography services have not been provided with reasonable care and skill or otherwise as required by law.
If you have a concern about your session, service or photographs, please contact Pin and Pose as soon as possible so the matter can be considered and, where appropriate, a reasonable solution offered.
Personal information is handled in accordance with the Pin and Pose Privacy Policy and applicable UK data protection law.
The Privacy Policy explains how personal information and photographs are collected, used, stored and shared.
Permission for Pin and Pose to use client photographs for promotional purposes is dealt with separately as explained in Section 19.
Pin and Pose may update these Terms & Conditions from time to time.
The Terms applying to a booking will normally be those provided or made available when the booking was made, unless a change is required by law or a different arrangement is subsequently agreed with the client.
These Terms are governed by the laws of England and Wales.
Nothing in these Terms excludes, restricts or overrides any statutory rights or remedies available to you as a consumer.
